Amendment to 13 August 1985 Speed Limit

AN AMENDMENT TO ESTABLISH SPEED LIMITS ON CERTAIN ROADS IN THE TOWN OF BELL

      WHEREAS, The Town Board of the Town of Bell, Bayfield County, Wisconsin finds that, based on investigation, the statutory speed limit on certain Roads in the Town of Bell, as further defined in this ordinance, is greater than is reasonable or safe under the conditions found to exist; and
WHEREAS, The Town Board declares the necessity to establish a reasonable and safe speed on said Roads different from that established by Wisconsin Statute;
WHEREAS, The Town of Bell has conducted studies in accordance with Wisconsin Transportation Bulletin Number 21 and taken into consideration those findings;
NOW, THEREFORE, The Town Board of the Town of Bell, Bayfield County. Wisconsin, pursuant to its authority under Section 349.11, Wis. Stat., in order to promote public safety and welfare, do ordain as follows:

SECTION 1. SPEED RESTRICTION. In addition to the sped restrictions set by the 13 August 1985 Speed Limit Ordinance, the speed restrictions for the following Roads located in the Town of Bell, Bayfield County, WI shall be twenty (25) miles per hour as approved by the Town Board at a regular meeting on 9
April 2010:
1. all roads in the vicinity of the plotted village

The speed restrictions for the following roads located in the Town of Bell, Bayfield County, WI shall be forty five (45) miles per hour as approved by the Town Board at a regular meeting on 10 August 2010:
1. Mountain Road
2. Stage Road

The speed restriction for the following roads located in the Town of Bell, Bayfield County, WI shall be thirty (30) miles per hour as approved by the Town Board at a regular meeting on 13 July 2010:

1. all other roads under the jurisdiction of the Town of Bell

SECTION 2. SIGNS. The Town Chairperson or his designee is authorized
and directed to install official signs necessary to effect the terms of this ordinance. Such signs shall be in conformity with the Uniform Traffic Sign Manual, the Wisconsin Administrative Code, and all other rules and regulations.

SECTION 3. SEVERABILITY. The provisions of this amendment are severable. In the event any portion of this amendment is determined to be unconstitutional, invalid, or unenforceable by a court of competent jurisdiction, such determination shall not affect the remainder of this ordinance. The Town Board hereby declares its intent to have passed all other provisions of this amendment and the remainder of the ordinance shall not be affected by such determination.

SECTION 4. EFFECTIVE DATE. This ordinance shall take effect and be in force from and after 14 September 2010.
