TOWN OF BELL, BAYFIELD COUNTY, WISCONSIN Injurious Matter on Roadway Ordinance
Ordinance No. 19-01.
The Town Board of the Town of Bell, Bayfield County, State of Wisconsin, being duly assembled at a regular Town Board meeting on April 16, 2019, does hereby ordain that the Injurious Matter on Roadway Ordinance No. 19-01, is hereby to read as follows:
Section 1- Title/Purpose
The Town of Bell, Bayfield County, adopts the following Injurious Matter on Roadway ordinance to prevent persons from placing or causing to be placed upon any highway or roadway any matter or substance that is or may be injurious to any vehicle and to further prohibit dragging from a vehicle upon roadways, particularly dragging sleds or wooden pallets, which can result in matter being Left on roadways.
Section 2- Authority
The Town Board of the Town of Bell has the specific authority, powers and duties pursuant to Wis. Stats. 86.04, 346.94(5) and 86.022 to regulate, prohibit and restrict construction, alteration, erection, enlargement or damage of certain structures and substances on town roadways that can cause safety hazards.
Section 3 -Adoption of Ordinance
The Town Board of the Town of Bell has, by adoption of this ordinance, confirmed the specific statutory authority, powers and duties noted in the specific sections of this ordinance and has established by these sections and this ordinance the regulation and control of certain uses, activities and operations in the Town of Bell.
Section 4 – Definition
Roadway: any area within the Town’s right of way where travel occurs on a public road.
Section 5 -Prohibited Acts.
No person, partnership, corporation, or other legal entity may place or cause to be placed upon any highway or roadway any matter or substance that is or may be injurious to any vehicle nor may any person, par1nership, corporation or other legal entity drag from a vehicle upon roadways, particularly dragging sleds or wooden pallets.
Section 6 – Penalty Provision.
Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this Ordinance shall, upon conviction, pay a forfeiture of not less than $100.00 for each violation. Each day a violation exists or continues shall be considered a separate offense under this Ordinance. In addition, the town board may seek injunctive relief from a Court of record to enjoin further violations.
Section 7- Effective Date
Following passage by the Town of Bell Town Board, this ordinance shall take effective thirty (30) days after the date of posting as provided by sec. 60.80, Wis. Stats.
Adopted by the Town Board of Supervisors for the Town of Bell on the 19th day of April 2019.
